The first of all is to know that this Ministry has the powers of the Autonomous Community in matters of environment, water, spatial and coastal planning and urban planning.

Areas of activity include water, environmental quality, hunting and fishing, climate and climate change, environmental education and volunteering, protected areas, forest fires, the natural environment, and urban planning and management. Of the territory.

Functions and powers

However, in each province the Ministries act through the Territorial Delegations that hold the following functions and competences in the area of ​​your province:

  • Ordinary representation of the Departments whose peripheral services are attached to the Territorial Delegation, and where appropriate, from the agencies attached to or dependent on the Departments.
  • Direct, under the functional dependence of the corresponding management centers, the administrative units belonging to the Delegation.
  • To exercise the leadership of all the staff of the Delegation and the ordinary administration and management powers of the same that are expressly delegated to them.
  • Establish the ordinary channel of relationship with the central services of the Ministries whose peripheral services are attached to the Territorial Delegation and, without prejudice to the powers attributed to the holders of the Government Delegations of the Junta de Andalucía, with the peripheral bodies of the General State Administration and the local entities of Andalusia in matters of their competence.
  • Transfer orders and instructions in matters that are within its competence to the heads of the Provincial General Secretaries of the Ministries whose peripheral services are attached to the Territorial Delegation.
  • The exercise of administrative powers with respect to those competences assigned to them and, where appropriate, with respect to those competences of the peripheral services to which they are assigned.
  • In addition to other functions that are attributed, decentralized or delegated to them.

Organic structure

The organic structure of the Ministry of the Environment and Spatial Planning is established by the Decree 216 / 2015, of 14 of July, which establishes that the aforementioned competences correspond to said Ministry.

Likewise, this Decree regulates the actions of this Ministry through the central governing bodies, the entities and the collegiate bodies attached to it.

Currently, the Minister for the Environment and Spatial Planning is José Fiscal López.

Central Governing Bodies

The head of the Ministry holds the representation of the same and exercises the superior direction, initiative, coordination, inspection and evaluation of its activities.

For immediate support and assistance to the head of the Ministry there is a Cabinet with a composition determined by specific regulations.

He exercises the superior leadership of the Ministry and the ordinary representation of the same after its holder, corresponding to the general delegation of this.

The General Secretariat for Spatial Planning and Urban Sustainability

It has the rank of Vice-Ministry, it is responsible for the direction, coordination and control of the activities of the General Directorate of Urbanism. It is responsible for promoting and coordinating the achievement of the objectives and the fulfillment of the actions related to the competent matters.

The General Secretariat for the Environment and Climate Change

General Technical Secretariat

It has specific competences in relation to the production of regulations and legal assistance, in relation to heritage, human resources, economic and financial management and contracting, as well as other activities.

Affiliated entities

The Environment and Water Agency is attached to the Ministry of the Environment and Spatial Planning (AMAYA) and the Foundation for Sustainable Development of Doñana and its Environment-Doñana 21.

The Environment and Water Agency (AMAYA)

This is one public business agency and an instrumental entity that provides essential services in the area of ​​the environment and water in Andalusia, especially due to emergencies that are declared.

The Agency can develop activities outside the territory of Andalusia in execution of programs and collaboration agreements signed by the Administration of the Junta de Andalucía.

The objective of the Agency is to carry out, by itself or through public or private entities in which it participates, activities related to the protection, conservation, regeneration or improvement of the environment and water, as well as any other activity that is budgeted. , complement, development or consequence of the aforementioned.

AMAYA Plenary

The Foundation for the Sustainable Development of Doñana and its Environment-Doñana 21

Doñana 21 is a foundation of the Andalusian public sector that acts as county development agency, with the vocation of being the benchmark for the management of the valuable resources of the Doñana territory.

He was born under the influence of I Sustainable Development Plan of Doñana and is subject to the protectorate of the Junta de Andalucía.

The governing body of the foundation is the Board of Trustees, in which the central and autonomous administration, the 14 town councils of the Region, trade union organizations and various financial entities are represented.

The Doñana 21 Foundation intends to make the execution of concrete and viable projects a reality that allow sustainable socioeconomic development of the municipalities of the Doñana Region, with a dual purpose:

  1. Public and private actions for the socioeconomic development of the Doñana Region.
  2. Social participation to achieve territorial cohesion, development and conservation of Doñana.

Collegiate bodies

In total there are some 7 affiliated collegiate bodies to the Ministry of the Environment and Spatial Planning and these are:

The Andalusian Council for the Environment

It was created as a social participation body capable of integrating and promoting the participation of the different social actors interested in environmental issues in our Community.

The Andalusian Biodiversity Council

It is a consultative body for advice and monitoring that promotes participation in relation to the protection and conservation of the natural environment.

Merge the old Forestry and Hunting Councils.

The Andalusian Water Council

It is the collegiate body for consultation and advice of the Andalusian Government on water matters. Its composition and operation are regulated by Decree 477/2015, of November 17.

The Andalusian Council for Spatial Planning and Urbanism

It is a collegiate body of a consultative and participatory nature. It is regulated by Decree 36/2014, of February 14, which regulates the competences of the Administration of the Junta de Andalucía in matters of Spatial Planning and Urban Planning.

The Territorial Commissions for Spatial Planning and Urban Planning

They are collegiate bodies at the provincial level of a consultative and decision-making nature. They are regulated by Decree 36/2014, of February 11.

The Territorial Observatory of Andalusia

It is of an advisory nature in matters of spatial planning. Its attributions are the monitoring, evaluation and prospective of the Andalusian territory and its planning, its evolution and trends, as well as the impact that public and private policies and actions have on it.

The Provincial Urban Coordination Commissions

They are collegiate bodies of a provincial nature, with coordination functions. This Commission is responsible for receiving requests for reports, opinions or other types of pronouncements that must be issued by the competent bodies and entities of the Administration of the Junta de Andalucía to the general planning instruments and their innovations that affect the structural organization, as well as their referral to the competent Administration for the processing of said planning.

With independence of these 7 collegiate bodies already mentioned, Decree 477/2015, of November 17, which regulates the Collegiate Bodies of Administrative and Social Participation of the Andalusian Water Administration establishes in article 8 that the collegiate bodies of administrative and social participation of a nature decision-making, advisers, control, management and coordination of the Andalusian Water Administration are the following:

  1. The Andalusian Water Council is included again.
  2. The Water Observatory.
  3. The Commission of Competent Authorities.
  4. The Monitoring Commission for the Prevention of Urban Floods.
  5. The Water Councils of the Hydrographic Demarcations.
  6. The Commissions for Drought Management.
  7. The Management Committees.
  8. The permanent Cabinet.
  9. The Commission for the Exploitation of the Guadiario-Guadalete transfer.
